It appears that BS is guilty of nothing more than poor attribution. I remember when I first saw the video, I thought that he had simply used footage from his 98 climb with him on the sat phone from the South Summit.
I still don't think that there is cause for legal activities. The Web sites in question only pointed out the differences and raised the questions - actions that were precipitated by the lack of acknowledgement of the nature of the video clip.
